This notice announces the availability of a Draft Watershed Implementation Plan proposed by New York State Department of Environmental Conservation (NYS DEC) to meet requirements of the Chesapeake Bay Total Daily Maximum Load (TMDL).
Public comment on this document will be accepted through June 7, 2019.

Background: The United States Environmental Protection Agency (US EPA) established the Chesapeake Bay Total Maximum Daily Load (TMDL) in December 2010. The TMDL – the largest ever developed by US EPA – identifies the necessary pollution reductions of nitrogen, phosphorus and sediment across Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia and the District of Columbia and sets pollution limits necessary to meet applicable water quality standards in the Bay and its tidal rivers and embayments. Each state is responsible for developing and implementing watershed implementation plans that describe the contributions each state will make towards achieving the necessary pollutant reduction targets set by US EPA. NYS DEC submitted to US EPA the final Phase I Watershed Implementation Plan covering 2010 to 2013 in December 2010 and the final Phase II Watershed Implementation Plan covering 2014 to 2017 in January 2013. The final Phase III Watershed Implementation Plan covering 2018 to 2025 will be due to EPA by August 12, 2019.
